1. Who this policy covers, and who it does not
This policy covers information Lynx Digital collects for its own purposes: running this website, answering enquiries, and serving our clients.
When we work for a client, the client is responsible for their data. We host websites, run AI assistants on client websites, manage advertising and analytics accounts, and process sales-lead emails for dealerships. In that work we handle personal information on our client’s behalf and on their instructions. If you are a customer of one of our clients, that business’s privacy policy governs your information, and requests about it should go to that business. We will help our client respond.
2. What information do we collect?
Information you give us
In short: we collect what you choose to provide.
- Contact details: name, email address, phone number, company, job title and mailing address, when you fill in a form, email us, call us or book a consultation.
- Account and billing details: when you buy a service or use our client store and support portal, your billing name and address, the services you have ordered, your invoices and your support requests. Card payments are processed by Stripe. If you pay for a recurring service, the card details needed to bill you each month are kept in encrypted form by our billing system and by Stripe. They are used only to charge the amounts you have agreed to, and you can ask us to remove a stored card at any time.
- Project information: what you tell us about your business, and any access you grant us to your website, hosting, advertising or analytics accounts so that we can do the work.
- Questions you ask our AI assistant: the text you type into Lynx Assist. See section 3.
Please give us accurate information and tell us when it changes.
Information collected automatically
In short: your browser sends some technical information when you visit.
When you visit our website we automatically receive technical information such as your IP address, browser and device type, operating system, language, referring page, the pages you view and when. From an IP address we may infer an approximate location (city or region). We do not collect precise location.
We use this to keep the site secure and working, and to understand how it is used.
We also collect information through cookies and similar technologies. See section 6.
Information from other sources
If a client gives us access to an account (for example a Google Ads, Google Analytics or Meta advertising account, or a website we host), we see the information in that account. We use it only to deliver the service to that client.
3. Our AI assistant (Lynx Assist)
In short: your question is sent to AI service providers to produce an answer, and we keep a log of questions and answers to improve the assistant.
When you ask Lynx Assist a question:
- Your question is sent to our AI providers. It is processed by a large language model provider (currently OpenAI) to generate the answer, and compared against our own published content using a search index hosted by Pinecone. Both are located in the United States. We use paid API access to these providers; your question is sent only to produce your answer.
- The assistant answers from our own published content, not from the open internet, and it does not look you up or build a profile of you.
- We keep a log of the question, the answer and the sources used, so that we can see what people ask and improve the answers. The log is not linked to a name or account unless you choose to tell the assistant who you are. We keep these logs for 12 months, then delete or anonymize them.
- We use your IP address briefly to limit how many questions one visitor can ask in a day. This protects the service from abuse.
Please do not type personal, confidential or sensitive information into the assistant, such as health, financial or legal details, passwords, or information about other people. The assistant gives general information about our services. It does not give professional advice.
4. How do we use your information?
We use personal information to:
- respond to you and provide the consultation, quote or service you asked for;
- deliver, bill for and support our services, including managing your account;
- run and secure our website, prevent abuse and fix problems;
- understand and improve our website, our content, our assistant and our services;
- send you service messages, and marketing messages only where you have agreed or the law allows it. You can unsubscribe at any time;
- comply with the law and protect our legal rights.
We do not use your information to make decisions about you by automated means alone.
5. On what basis do we use it?
We are an Alberta corporation, and we handle personal information in accordance with Alberta’s Personal Information Protection Act and, where it applies, Canada’s Personal Information Protection and Electronic Documents Act. Our commercial email follows Canada’s Anti-Spam Legislation.
We collect, use and disclose personal information with your consent, which may be express (you tell us) or implied (for example, you send us a question and we use your email address to answer it), and only for purposes a reasonable person would consider appropriate. You can withdraw consent at any time (section 10), subject to legal or contractual limits.
In limited circumstances the law permits or requires us to act without consent, for example to investigate a breach of an agreement or a contravention of law, to comply with a subpoena, warrant or court order, or where the information is publicly available as defined by regulation.
6. Cookies and analytics
In short: we use cookies to run the site and to measure how it is used.
We use cookies and similar technologies to keep the site working and secure, remember preferences, and measure usage.
- Google Analytics. We use Google Analytics, loaded through Google Tag Manager, to measure how our website is used. Google may set cookies and receive your IP address and information about your visit. We do not use it to advertise to you. You can opt out with the Google Analytics browser add-on. See how Google uses information from sites that use its services.
- Fonts and avatars. Our pages load fonts from Google Fonts and may load avatar images from Gravatar. Loading these sends your IP address to those services.
- Assistant. The assistant uses your browser’s storage to keep your current conversation on screen.
Most browsers accept cookies by default. You can set your browser to refuse or delete cookies; some features may then not work as intended. We do not currently respond to “Do Not Track” or Global Privacy Control browser signals, because no common standard for doing so has been adopted.
7. When and with whom do we share your information?
In short: with service providers who work for us, and where the law requires. We do not sell personal information.
Service providers. We share personal information with companies that perform services for us and need it to do that work, under contracts that limit what they may do with it. The categories are:
- website hosting and infrastructure;
- AI and search providers (for the assistant);
- website analytics;
- payment processing and billing;
- email, support and collaboration tools;
- domain registration and hosting partners, where you buy those services through us.
Business transfers. If we sell or merge all or part of our business, personal information may be transferred as part of that transaction, subject to this policy.
Legal reasons. We may disclose information where required by law, or where necessary to protect our rights, our clients or the public.
We do not sell personal information, and we do not share it with third parties for their own marketing.
8. Where is your information stored?
In short: mostly in the United States.
Our website is hosted on servers in the United States, and several of our service providers (including our AI, search, analytics and payment providers) are located in the United States or other countries outside Canada. Your information may therefore be stored and processed outside Canada, and may be accessible to courts, law enforcement and national security authorities of those countries under their laws.
You can ask us about our policies and practices for service providers outside Canada, and about how those providers handle personal information on our behalf, by contacting our privacy contact (section 13).
9. How long do we keep it, and how do we protect it?
We keep personal information only as long as we need it for the purposes in this policy, or as the law requires (for example, tax and accounting records). When we no longer need it we delete or anonymize it, or, where that is not yet possible (for example in backups), we store it securely and isolate it until deletion is possible.
We use reasonable technical and organizational safeguards appropriate to the sensitivity of the information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a security incident creates a real risk of significant harm, we will notify the affected people and the regulator as the law requires.
10. Your rights and choices
You may ask us to:
- tell you whether we hold personal information about you, and give you access to it;
- correct information that is inaccurate or incomplete;
- delete information we no longer need;
- withdraw your consent to a use of your information, subject to legal or contractual limits;
- stop sending marketing email, by using the unsubscribe link in any message or by contacting us.
Email support@lynxdigital.com. We may need to verify your identity before acting. We will respond within the time the law allows (in Alberta, generally 45 days). There is no charge for making a request; if access will involve a cost we will tell you first.
If you are not satisfied with our response, you may contact the Office of the Information and Privacy Commissioner of Alberta (oipc.ab.ca) or the Office of the Privacy Commissioner of Canada (priv.gc.ca).
Residents of other places. Wherever you live, we will consider and act on a request to access, correct or delete your personal information as described above.
11. Children
Our website and services are intended for businesses and adults. We do not knowingly collect personal information from anyone under 18. If you believe a minor has given us personal information, contact us and we will delete it.
12. Changes to this policy
We may update this policy. The “Last updated” date at the top shows the current version. If we make a material change we will post a notice on our website or tell you directly.
